agree to the terms, conditions and disclaimers.
By purchasing an item advertised on this website,
you agree to be bound by these Terms and Conditions.
Flowershop.co.za may amend these Terms and Conditions
from time to time and any amendment will become
effective immediately. Your continued use of
this website after amendment constitutes an
agreement to abide by and be bound by those
Terms and Conditions, as amended.

Detailed
description of goods and/or services: FLOWERSHOP.CO.ZA
is a business in the flower & gift industry
that markets flowers & gifts.

Delivery
policy:Subject to availability and receipt
of payment, requests will be processed within
1 working day and delivery confirmed by way
of order number.

Same
Day Delivery: Monday to Friday
Same day delivery throughout South Africa, on
orders placed before 13:00 in the recipient's
time zone. Same day delivery can be available
on orders placed after these times, but it is
not guaranteed.

Delivery:
Saturday
Saturday delivery is available throughout South
Africa on orders placed before 17:00 in the
recipient's time zone. Saturday delivery can
be available on orders placed after this time,
but it is best to confirm before placing the
order.
Please note: Deliveries to remote or difficult
delivery areas may not be same-day guaranteed.
Please note: We can not guarantee Sunday deliveries,
however we will always try our very best to
get it there as requested.

Non-Deliveries
Flowershop.co.za and their supplying florists
will try their best to deliver any gift, but
we do not guarantee the delivery of any product
if one of the following occurs:
a) Recipient refuses to accept delivery of
the gift ;
b) Address provided is incorrect;
c) Occupants are not at the location and do
not respond to the "not at home"
card left by our florist.
If one of these instances occurs, we may judge
that the delivery has been made.

Recipient
"Not at Home"
Flowershop.co.za requires you the customer
to make sure that the recipient will be at
the location on the date given on the order
form for delivery together with a contactable
telephone (Mobile and Landline) number. Flowershop.co.za
is not responsible for deliveries if the recipient
is not at the location at the time of delivery.
If there is a contact phone number on the
order form, we may contact the recipient
to check if they are at the location before
we attempt to deliver the gift. If there is
no phone number provided on the order form,
we will attempt to deliver the gift on the
specified delivery date.
If the recipient is not at the location when
the delivery is made, the supplying florist
will try to leave a "not at home"
card at the recipient's location. This card
explains the situation and asks the recipient
to contact the supplying florist.
Flowershop.co.za will do their utmost to deliver
the gift at a later date if the recipient
replies to the "not at home" card.
Additional delivery charges may apply if the
supplying florist has to deliver the gift
more than once. Alternatively, the recipient
may have to collect the order at the florist's
premises.

Time
Sensitive Deliveries
We do not guarantee timeous delivery
to the following timed events : Funerals,
Wedding Receptions, Parties, or Functions.
We will however do our best to get your gift
to the place at the requested time.
7.a. RUSH ORDERS PROCESSED IN GOOD
FAITH WILL BE CONSIDERED COMPLETED ON
DELIVERY and because of the nature
of rush orders we will not credit the
orders, once placed, where the delivery
differs from what was ordered.

Return
and Refunds policy: The provision of goods
and services by FLOWERSHOP.CO.ZA is subject
to availability. In cases of unavailability,
FLOWERSHOP.CO.ZA will substitute the product
for another product of similar quality and value.
Cancellation of pre-paid undelivered orders
by the client will attract a 30% administration
fee.

Cancellations
Flowershop.co.za cannot cancel any order that
has already been made up by the supplying florist,
even if the florist has not delivered the order. If
the cancellation request is made before make
up, then Flowershop.co.za may be able to cancel
the order. However, Flowershop.co.za cannot
guarantee that the order can be cancelled.

Refunds
Is is not normally Flowershop.co.za policy to
refund the price of the product. However, as
every customer and gift are individual, (and
therefore may require a decision on a case-by-case
basis), please contact us so we can determine
the best solution to the problem. We are
also able to provide other solutions, such as
resending the gift, or resending a different
gift of the same value.

Timed
Deliveries
While we offer customers the opportunity to
nominate a preferred time of delivery, including
"as soon as possible" (ASAP), it is
not possible to guarantee that these times will
be achieved. Flowershop.co.za uses local florists
to deliver flowers so that you get the freshest
possible gift. Consequently, there are often
local reasons why an order can not be delivered
within your preferred time frame.
We suggest you restrict your requests to AM
or PM delivery or ASAP if that is important
to you. Such deliveries can only be made during
local business hours.
Also, it is usually possible though not guaranteed
to deliver on a Saturday up to noon. It is not
usually possible to deliver on Saturday afternoon
or Sunday or on national public holidays.
If the flowers are for a timed event like a
funeral, the florists will do their best to
assist. However, we strongly recommend that
you give an alternative address so the flowers
can be delivered there if too late for the timed
event.

Difficult
Deliveries
Delivery to difficult and remote areas may incur
extra delivery (reduced flower value), above
that already allowed in the flower value. The
customer will be contacted/advised on their
given contact details.
If a delivery should not be made before a certain
time (for example, if the recipient is leaving
the hotel), please either provide an alternative
delivery address within the same delivery area
or advise that the order should be cancelled
by calling 082 093 1516. Should the recipient
be leaving work, then the delivery will take
place on the following day.
Personal contact numbers for the recipient (or
someone close to the recipient) are required
for: Hospitals (especially Intensive Care Units,
and Maternity Wards, etc), Secure Buildings,
Hotels, University and School Hostels - as these
can prove to be very difficult to find the recipient.

Customer
privacy policy: FLOWERSHOP.CO.ZA shall take
all reasonable steps to protect the personal
information of users. For the purpose of this
clause, "personal information" shall
be defined as detailed in the Promotion of Access
to Information Act 2 of 2000 (PAIA). The PAIA

Payment
options accepted: Payment may be made via
Visa, Master Card, and Diners Club credit cards
or by bank transfer (internet transfer EFT or
direct deposit) into the FLOWERSHOP.CO.ZA bank
account, the details of which can be viewed
at http://www.flowershop.co.za/contact
us.htm

Credit
card acquiring and security: Credit card
transactions will be acquired for FLOWERSHOP.CO.ZA
by PayGate (Pty) Ltd who are the approved payment
gateway for Standard Bank of South Africa. PayGate
use SSL3 and no credit card details are stored
on the website. Users may go to www.paygate.co.za
to view their security certificate and security
policy.

Customer
details separate from card details: Customer
details will be stored by FLOWERSHOP.CO.ZA separately
from card details which are entered by the client
on PayGate's secure site. For more detail on
PayGate refer to www.paygate.co.za
Merchant Outlet country and transaction currency.
The merchant outlet country at the time of presenting
payment options to the cardholder is South Africa.
Transaction Currency is ZAR (South African Rand).

Responsibility:
FLOWERSHOP.CO.ZA takes responsibility for all
aspects relating to the transactions made directly
through FLOWERSHOP.CO.ZA, including sale of
goods and services sold on this website, customer
service and support, dispute resolution and
delivery of goods. This excludes sales of goods
or services made through affiliate companies
on this website, customer service and support,
dispute resolution and delivery of goods.

Country
of domicile: This website is governed by
the laws of South Africa and FLOWERSHOP.CO.ZA
chooses as its domicilium citandi et executandi
for all purposes under this agreement, whether
in respect of court process, notice, or other
documents or communication of whatsoever nature,

change this agreement or any part thereof at

any time. Changes in service will be posted
on the FLOWERSHOP.CO.ZA site. If any portion
of these Terms and Conditions or any change
of this Agreement of the Service is unacceptable
to you or will cause you to no longer be in
compliance with the Agreement then discontinue
using this service immediately. Continued use
of the service now or following posted notices
of changes in this Agreement means that you
have accepted and are bound by the changes.
